Supreme Court to pronounce verdict today in case against 52 office bearers of constitutional bodies

Kathmandu. The Supreme Court is pronouncing its verdict on Wednesday in a case against 52 office bearers of constitutional bodies.

The judges of the Constitutional Bench are engaged in discussions on what to decide, according to Supreme Court sources. The five-member Constitutional Bench comprises Chief Justice Prakash Man Singh Raut, Justices Sapana Pradhan Malla, Manoj Kumar Sharma, Kumar Chudal and Nahakul Subedi.

After the arguments in this case, which has not been resolved for four years, the date for pronouncing the verdict was fixed on Jestha 28 after the conclusion of the debate on Jestha 1, but it was postponed due to differences of opinion among the judges and lack of time.

These 52 office bearers were appointed during the then KP Sharma Oli-led government. The legal provisions related to the Constitutional Council were amended through an ordinance to appoint them.

The then Prime Minister Oli had amended the provisions of the Constitution and Act regarding the formation of the Constitutional Council through an ordinance before deciding to dissolve the House of Representatives on Poush 2077 to avert a crisis within his party, the NCP.

Advocate Om Prakash Aryal and others had filed 15 writ petitions in the Supreme Court, arguing that amending the provisions related to the Constitutional Council through an ordinance was unconstitutional.
